Terms of Use

1. Agreement

By downloading or using CalDaily you agree to these terms and to our Privacy Policy. Apple's Standard Licensed Application End User License Agreement also applies to your use of the app. If you do not agree, please do not use CalDaily.

2. Not medical advice

CalDaily provides general nutrition and weight tracking information. It is not a medical device and does not diagnose, treat or prevent any condition. Calorie and macro targets are calculated from standard formulas and your answers, and may not suit your situation. Talk to a doctor or registered dietitian before starting a diet, especially if you are pregnant, have a medical condition or have a history of disordered eating.

3. Nutrition data and estimates

Food information comes from third-party sources, including USDA FoodData Central and Open Food Facts, and may contain errors or be out of date. Portions and nutrients from photo analysis are AI estimates and can be significantly wrong, so please review and adjust them before saving. You are responsible for checking the entries you log.

4. CalDaily Pro subscriptions

• CalDaily Pro is offered as an auto-renewing subscription, billed monthly ($9.99) or yearly ($39.99) in US dollars or the local equivalent shown in the App Store.
• Both plans include a 3-day free trial for eligible new subscribers. If you do not cancel at least 24 hours before the trial ends, you will be charged for the plan you chose.
• Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your iPhone settings under your Apple ID. Cancelling stops future renewals; you keep Pro until the end of the period you paid for.
• Refunds are handled by Apple under its policies. We cannot issue refunds directly.
• Prices may change. Any change will apply only to future renewal periods and Apple will notify you as required.

5. Fair use

Pro includes up to 50 AI photo analyses per month. Food search and barcode scanning are subject to reasonable limits that normal use will not reach. We may limit or suspend access if we detect automated or abusive use.

6. Acceptable use

Do not reverse engineer, disrupt or overload the app or its services, use it to submit false data to shared food databases, or use it in any unlawful way.

7. Your data

Your diary, weight log and profile are stored on your device. You are responsible for your device and for keeping backups if you want them. See the Privacy Policy for details.

8. Ownership

CalDaily, its design, logo and content are owned by us and protected by intellectual property laws. These terms give you a personal, non-transferable licence to use the app.

9. Disclaimers

CalDaily is provided "as is" and "as available". We work hard to keep it reliable, but we do not guarantee that it will be error-free or always available, or that it will help you reach a particular result.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, or for decisions you make based on information in the app. Nothing in these terms limits liability that cannot be limited by law.

11. Changes

We may update these terms. We will change the date at the top and, for significant changes, let you know in the app. Continuing to use CalDaily after an update means you accept the new terms.

12. Governing law

These terms are governed by the laws of France, without prejudice to any mandatory consumer protection rules of the country where you live.
